Terms Of Service

Client has requested data related to telephone numbers on a state or federal Do-Not-Call registry (DNC). Client has researched
the TCPA and other DNC rules and will only use the data in strict compliance with the law, such as when Client has proper
consent or other sufficient exemptions.

Client assumes all risks related to contacting numbers on the DNC and agrees that Ally Data Group cannot ensure the compliance of Client's campaigns. Ally Data Group will not be held liable for Client's compliance
mistakes and Client will indemnify Ally Data Group in the event Ally Data Group incurs any loss related to Client's conduct.

Client has requested wireless telephone number data. Client has researched the TCPA and other wireless calling rules and will only use
the data in strict compliance with the law, such as when Client has proper consent or other sufficient exemptions. Client assumes
all risks related to contacting wireless phones and agrees that Ally Data Group cannot ensure the compliance of Client's
campaigns.

Ally Data Group will not be held liable for Client's compliance mistakes and Client will indemnify Ally Data Group in the
event Ally Data Group incurs any loss related to Client's conduct.

By executing a Order Confirmation, Customer agrees that Ally Data Group takes no responsibility for email soft bounces, deliverability rates, and/or third-party deployment results or any actions related to their internet service provider and/or third-party email deployment service. Ally Data Group is also not responsible for customer’s email creative, design and/or text, which may result in a soft bounce. Requests for hard bounce replacements must be provided within 15 days of data delivery.  Further, Client agrees that it has researched the federal CANSPAM Act and similar email solicitation laws and will fully comply with the same. Ally Data Group will not be held liable for Client's compliance mistakes and Client will indemnify Ally Data Group in the event Ally Data Group incurs any loss related to Client's conduct.
